DWI/DUI Conviction Penalties in New York
Jail Time
If convicted of DWI in New York, you can face up to one year in jail. If you get a second conviction within 10 years, the jail time increases to four years. If you get a third DWI within 10 years, that can land you seven years in prison.
Suspension or revocation
In New York state, the DMV can revoke or suspend the license of any NY driver who has been convicted of a DWI for up to 1 year. If your license is revoked (the worse of the two), you must reapply for a new license once the revocation period ends — this includes the road test as well as the exam.
Fines
If convicted of DWI in NY, you can be fined up to $2,500, dependent on your BAC (blood alcohol content). A second conviction with 10 years is a fine of up to $5,000. If you get a third conviction with 10 years, up to $10,000
